What is Justice?

"Wisdom inspireth life into her children, and protecteth them that seek after her, and will go before them in the way of justice."  Ecclesiasticus Chapter 4, Verse 12.

In 1789 our our country was born.  Those men who framed our constitution envisioned a society in which all men would be considered equal, regardless of socio-economic status.  In many ways, we have lost sight of the original vision of our founding fathers.  Thier vision was one in which justice was predicated upon the principals of wisdom and due process.  Wisdom as stated in the quote above, is a gift which leads us on the path to justice.  Justice, in our court system entails a basic understanding of due process of law. 

Due Process is defined in the preamble, and the various amendments to our constitution.  Thomas Jefferson in drafting our constitution stated very eloquently that no man shall be denied life, liberty, or the pursuit of happiness without first knowing the charges against him, and without first having the opportunity to be heard on those charges. 

Judges are the gatekeepers of due process.  It is the role of every judge to treat all persons coming before them respectfully and equally.  Furthermore, it is the role of every judge to provide each litigant coming before them a fair and impartial tribunal; one in which all persons have the opportunity to be heard.  Without that fair and impartial tribunal, justice will die, and our rights can not prevail.

I believe that as a judge it would be my responsibility to uphold the tenants of due process. I do understand why we can never lose sight of those rights.  I can only promise you voters fairness and impartiality in every decision I make.  I do expect people to disagree with me on decisions that I would make as a judge, but everyone will know why I have made those decisions.    And every decision I make, will keep in mind why our courts exist, and what the court's function is in our society.
